I remember the day I received the manila envelope from Sister Angela, immigration caseworker for a local charity. It contained a stack of newspaper clippings and immigration documents. A hurriedly scribbled post it note said simply “Their case has been denied, Mark, please help them.”
The newspaper articles told the story of a doctor who had brought a family of three refugee kids from Kosovo, Serbia to the United States. NATO forces had bombed their house on accident, and most of their entire family died. The youngest brother and his sister were severely disfigured by shrapnel. The eldest brother who witnessed the incident suffered post traumatic stress syndrome and could barely speak.
The immigration documents indicated that they arrived as refugees to the U.S. to receive extensive reconstructive surgery. Their refugee case had languished for years and was finally denied because nobody had responded to the U.S. Government’s request for information. Someone had dropped the ball.
I went to my boss, the Managing Lawyer of the firm. I told him what had happened, and asked if I might work on the case without charge, on a “pro bono” basis. He informed me that he couldn’t afford to do it for free. However, if I wanted to work for free, I had to do it on my own time, between 10 at night and 6 in the morning.
I realized two things in that moment. First, I could not work for my boss any longer. Second, that I would do whatever it took to get their cases back on track and their permanent residency approved.
I ignored my boss and immediately contacted the U.S. Immigration Service. I explained the situation to the Service and paid the delinquent filing fees out of my own pocket. The government eventually reinstated their refugee cases and granted them permanent residency. I left the firm two months later to start out on my own and founded Immigration and Naturalization Attorneys.
